Judge Rules Sex Offender Too Short For Prison

Gives Probation Instead

SIDNEY, Neb. ” A judge said a 5-foot-1 man convicted of sexually assaulting a child was too small to survive in prison, and gave him 10 years of probation instead.

His crimes deserved a long sentence, District Judge Kristine Cecava said, but she worried that Richard W. Thompson, 50, would be especially imperiled by prison dangers.

“You are a sex offender, and you did it to a child,” she said.

But, she said, “That doesn’t make you a hunter. You do not fit in that category.”
Thompson will be electronically monitored the first four months of his probation, and he was told to never be alone with someone under age 18 or date or live with a woman whose children were under 18. Cecava also ordered Thompson to get rid of his pornography.

He faces 30 days of jail each year of his probation unless he follows its conditions closely.

“I want control of you until I know you have integrated change into your life,” the judge told Thompson. “I truly hope that my bet on you being OK out in society is not misplaced.”

    And where does the line to recall/impeach the judge start? And why is anyone upset at the guy who went around a city in the northeast last month knocking off sex offenders? When are these judges going to wake up and start realizing that the victims are the VICTIMS not the flipping perps?

    It is disgusting what people can get away with. Lenient judges make me sick, but not as sick as what some people can get away with…

    For instance: Did you know that in Minnesota, you can videotape anyone in your own home, no matter what their age, no matter what they’re doing, and without their knowledge. That means that a man can videotape his step-daughter taking a shower, dub it onto a tape with other porn, and not get punished in any way for it. :mad:

    That’s illegal in other states, but not here.

    And then you hear about judges who have all the power to punish someone who has done wrong, and they choose not to. Sickening. :shock:

    Too small to survive prison? I didn’t know there was a height requirment for prison. “You must be this tall to ride”…that’s the scariest thing I’ve ever heard of.

    How ’bout the children who are too small to survive this man?

    This is when I would definitely turn a blind eye to any citizen who opted to go for some justice of their own….but I hope it’s a short person who whoops this guy’s ass because he won’t go to jail for it….being short and all…he’ll only get probation in town..:twisted:

    Isn’t it within the power of the legislative branch to remove judges?

    I think maybe this branch of our government has been derelict in their duty because basically they never remove judges.

    Zelda, in answer to your question, the answer is “sometimes”. It almost entirely depends on how the judge got their position. an appointed judge can be impeached by the legislature for misconduct or malfeasance. Elected judges are another story. They can be VERY hard to remove as long as people keep voting for them.

    I am from the town of Sidney Nebraska, I am trying like heck to get justice for this little girl. We are protesting every night at the courthouse at 6:00 p.m. We have a petition going around to try and remove her from office? Does anyone know anything about removing an elected judge from office? I am a mother of 3 young girls and I am mad as hell about this. I would appreciate any suggestions from anyone regarding this case. We are a small community, and there are so many people worried about “pissing someone off” or just turn there cheek when they

    Jessica- I know for a fact that Fox News has broadcast this as I saw it yesterday. I believe some of the other cable networks did this as well. That is a huge start! Take advantage of it! I would look for an attorney that is in the same boat as yourself..one that is mad and wants this judge gone….the attorney can do the leg work and I would bet things would move faster…

    Now that being said, I know that the process of removing a judge from office is difficult to say the least. I would suggest that those willing participants in your area start a letter writing and phone campaign to the judicial review board in your state. See if there are enough admonishments from the board against the judge…Admonishments of the judge are a matter of public record..just as those against an attorney…It would be my guess that this judge has made this type of ruling in the past and I would hope that diciplinary action has been taken before.

    My mother used to date rich when we lived in Sidney. I knew he was different. Every Night Instead of Sleeping in their bed he would lay on the couch and watch Pornographic Material. I for one have seen his power and fight i feel he should be put in prison size doesnt matter!
