Can you say deserter? One would be hard pressed to see this based on this article. The Seattle Times is trying to whitewash the reality of the situation!
In a rare case of officer dissent, a Fort Lewis Army lieutenant has refused orders to head out to Iraq this month to lead troops in what he believes is an illegal war of occupation.
1st Lt. Ehren Watada’s Stryker brigade is scheduled to make its first deployment to Iraq this month. His refusal to accompany these troops puts him at risk of court-martial and years of prison time.
“I feel that we have been lied to and betrayed by this administration,” Watada said Tuesday in a telephone interview from Fort Lewis. “It is the duty, the obligation of every soldier, and specifically the officers, to evaluate the legality, the truth behind every order — including the order to go to war.”In making his decision, Watada has reached out to peace groups, including clergy, students, some veterans opposed to Iraq and others. Some war critics are raising money for his legal defense as they seek to galvanize broader opposition to Bush administration policy in Iraq.
“There has been an outpouring of support in the Puget Sound area,” said David Solnit, who works with the anti-war group Courage to Resist. The group and others are helping organize a press conference today in Tacoma to launch the support campaign.
He can reach out all he wants, but this is an Officer in The United States Army that is willfully defying orders. The penalty for this is severe.

First, he stated, “It is the duty, the obligation of every soldier, and specifically the officers, to evaluate the legality, the truth behind every order — including the order to go to war.” This is wrong It is not the duty of every soldier to evaluate the legality of every order. It is the duty of every soldier is to follow all LAWFUL orders.It sounds as if he has been planning this. If it can be proven that he is doing this to encourage other soldiers to do this, he would be guilty of formenting a mutiny - a capital offense. This is Article 94 of the Uniform Code of Military Justice:
ART. 94. MUTINY OR SEDITION
(a) Any person subject to this chapter who–(1) with intent to usurp or override lawful military authority, refuses, in concert with any other person, to obey orders or otherwise do his duty or creates any violence or disturbance is guilty of mutiny;
(2) with intent to cause the overthrow or destruction of lawful civil authority, creates, in concert with any other person, revolt, violence, or disturbance against that authority is guilty of sedition;
(3) fails to do his utmost to prevent and suppress a mutiny or sedition being committed in his presence, or fails to take all reasonable means to inform his superior commissioned officer or commanding officer of a mutiny or sedition which he knows or has reason to believe is taking place, is guilty of a failure to suppress or report a mutiny or sedition.
(b) A person who is found guilty of attempted mutiny, mutiny, sedition, or failure to suppress or report a mutiny or sedition shall be punished by death or such other punishment as a court- martial may direct.

I decided to find out if Lt. Watada or his father have had any associations with anti-war groups or anti-war movements. After a short time on Google, this turned up—a posting on a forum at the University of Hawaii:

Note that Watada is not seeking conscientious objector status, because he does not oppose all wars, only this particular one.
Which puts Lieutenant Watada on the horns of a dilemma.Let us assume that Lieutenant Watada is sincere. We owe him that much.
If so, he is taking the high road. His sole defense of his actions is going to be “Refusing an illegal order.” Absent a *stunning* action on the part of a Courts Martial panel, he’s going to get convicted. His defense team is going to have to be miracle workers to successfully assert that the war in Iraq is illegal in terms by which it will excuse his actions - and, by extension, condemn every other serving officer as a war criminal for not having refused. Oh, there’s room to maneuver in there, but when you strip it down to the essentials - that’s it.

This also makes me think of ARTICLE 88 of the UCMJ: “Any commissioned officer who uses contemptuous words against the President, the Vice President, Congress, the Secretary of Defense, the Secretary of a military department, the Secretary of Transportation, or the Governor or legislature of any State, Territory, Commonwealth, or possession in which he is on duty or present shall be punished as a court-martial may direct.”
The military better handle this little dude…

Someone needs to explain to this meat head exactly what is going to happen to him. A general courts martial and dishonorable discharge (whether they send him to Leavenworth or not) is still a federal felony conviction. He will not be able to become an attorney, police officer, or any other officer of the court without a presidential pardon. His odds of becoming a doctor are also severely limited. His right to vote is revoked in most states until a pardon would be received. He will never be permitted to legally purchase a firearm. Or become a pilot.
At this point in time, the military has no choice but to prosecute him. He is utterly worthless as a combat officer as few if any soldiers would follow him. In fact, for his own safety, about the only place he wouldn’t risk being fragged would be in Leavenworth. They could offer to allow him to resign for the good of the service which is a less than honorable but not a dishonourable discharge. Seeing as he has been trying to resign for ages, I would bet that he only went into ROTC as a means to have his college paid for by the military while having no intention to actually serve. With that in mind, I would suggest that he be considered for charges of fraud. If I remember correctly (it’s been 22 years) the oath flat out says that you are taking the oath freely without reservation or for purpose of evasion. Obviously he did have reservations and therefore LIED when he took the oath. He should therefore also be charged with PERJURY.
All told, his little stunt has racked up enough violations of the UCMJ that he could be a grey haired old man before he breathes free air again. I wonder how proud his dad’s going to be when he realizes that his instigating has gotten his son a nice long prison sentence. Oh wait I forgot he thinks the kid is going to get out scott free. He is too stupid to realize that a court martial isn’t a civilian court. His attorney doesn’t get to cherry pick the jurors. The convening authority appoints the jurors, and all of them will be higher ranking officers, and they aren’t going to show this little moron ANY mercy. Another thing Dad needs to take into account is that once in Leavenworth, junior’s going to be in with a bunch of people who aren’t necessarily predisposed to liking officers and especially cowardly ones.

It’s a sad situation really. It’s pretty much dominating the news here in Seattle. FrmrArtyOffcr, you’re right, he faces some pretty stiff reprocussions and may live to regret his actions. Having seen him interviewed, I believe he (and his father) are very clear on the legal consequences.
I personally believe that the Army is having such trouble with recruiting they’re going to go relatively easy on him. He’s not going to get off scott free, but I doubt he’ll serve much jail time.

Chuck, the Army is not that desperate. The Army is not like a local McDonalds that will keep someone just to fill a shift. This guy will not get off easy by any stretch of the imagination!
When this is all said and done and if he goes through with his plan and does not go with his platoon…he will be court martialed…the severity of that does not end when he walks out of prison…he carries that with him on his record and records are checked in employment..

What I don’t understand is how he could be a 1lt and not have known he would be sent to war? If he was so damn opposed to this war, he could’ve selected a non combat arm branch and been sitting behind a desk for the duration of his career. He doesn’t have the luxury of claiming that he didn’t know that there was a war in Iraq, it started before he was commissioned. He almost certainly could’ve opted for a service and support branch and not been in this situation. I think he may have chosen a combat arms branch just to pull this stunt.
The Army needs to throw the book at him simply because it’s detrimental to morale to have morons pull stunts like this. Recruitment will actually be improved because it’ll prove that the Army isn’t looking for cowards to command its troops. Soldiers rally around a tough as nails leader but shy away from limp wristed ones.
