Is John Kerry In Violation Of The Logan Act? How About Bill Nelson?

I saw the link at 7.62mm Justice and decided to do some investigating. Is John Kerry or Bill Nelson, for that matter, in violation of the Logan Act?

Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.

This section shall not abridge the right of a citizen to apply, himself or his agent, to any foreign government or the agents thereof for redress of any injury which he may have sustained from such government or any of its agents or subjects.

Many articles have been written on Kerry and the Logan Act, dating back as far as his Vietnam Service. Peek through them, as it is very good reading.  I tend to think he is in violation but what say you?

      I’m with Snowy Egret on this one. I think he’s guilty of alot more than being in violation of the Logan Act. However if we can get him removed from Congress for the violation of the Logan Act, I’d say it’s a good start.

      5- actually he didn’t and he broke the law in doing so..he had not been discharged from the military when he did it.

      5, Kerry, Nelson, Jay Rockefeller, and Rep. George Miller all should be stripped of their offices and be in jail for running their own Foreigh Policy initiatives. They aren’t authorized by the Executive branch, and are violating not only the Logan act, but the Constitution.

      Kerry should be shot for meeting with the enemy during Vietnam and becoming their agent in the US. That is one reason there is a Museum honoring Kerry in Vietnam.

      I would hope that at the Communist Kerry museum they would have a display for Jane Fonda too. She was a traitor of far more than just Honorable Mention status! She certainly deserves recognition!

      I have a question. If Kerry, Nelson, etc. are violating a law, the Logan Act, how are they getting away with it. Who would be the investigator and prosecutor and why aren’t they doing anything about it?

      Personally, I would like to see Kerry out of office. I think he doesn’t belong there and while the citizens of MA elected him, I sure didn’t and he sure as hell doesn’t represent me.
