Does the Convention on the Prevention and Punishment of the Crime of Genocide Adopted by Resolution 260 (III) A of the U.N. General Assembly on 9 December 1948. Entry into force: 12 January 1951, meet Jimmy Carter’s legal definition of genocide?

Here is what Jimmy had to say on Darfur:

“There is a legal definition of genocide and Darfur does not meet that legal standard. The atrocities were horrible but I don’t think it qualifies to be called genocide,” he said. Washington is almost alone in branding the 4 1/2 years of violence in Darfur genocide. Khartoum rejects the term, European governments are reluctant to use it and a U.N.-appointed commission of inquiry found no genocide, but that some individuals may have acted with genocidal intent. Carter, whose charitable foundation, the Carter Center, worked to establish the International Criminal Court (ICC), said: “If you read the law textbooks : you’ll see very clearly that it’s not genocide and to call it genocide falsely just to exaggerate a horrible situation I don’t think it helps.

Here is the UN definition of genocide:

Article II: In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:

(a) Killing members of the group;
(b) Causing serious bodily or mental harm to members of the group;
(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
(d) Imposing measures intended to prevent births within the group;
(e) Forcibly transferring children of the group to another group.

Article III: The following acts shall be punishable:
(a) Genocide;
(b) Conspiracy to commit genocide;
(c) Direct and public incitement to commit genocide;
(d) Attempt to commit genocide;
(e) Complicity in genocide.

Now keep in mind that :

On September 18, 2004, the UN Security Council passed Resolution 1564, which called for a Commission of Inquiry on Darfur to assess the Sudanese conflict. The UN report released on January 31, 2005 stated that while there were mass murders and rapes, they could not label it as genocide because “genocidal intent appears to be missing”

So if Darfur does not meet the standards of genocide, set forth by the UN, what situation does? What part pailed to meet their standard? Am I to call it a Humanitarian catastrophe (est. 200,000-400,000 dead and 2,500,000 refugees)
