One of the victims was a 3-year-old child enjoying ice cream at Baskin-Robbins:
As new questions arose about the man police say is responsible for the tragedy, several hundred friends and relatives gathered Saturday night outside an ice cream shop to mourn three lives suddenly lost.
“It hurts now,” said Vito Kudlis, surrounded by friends as he and his wife, Enely, wept for their 3-year-old son, Marten. “It is freaky. It is crazy.”
Marten, Patricia Guntharp, 49, of Centennial and Debra Serecky, 51, of Aurora all died when a Thursday night collision caused vehicles to careen into the Baskin-Robbins at the corner of South Havana Street and East Mississippi Avenue.
Saturday night, they were remembered in a candlelight vigil. Small children held glow sticks as others added stuffed animals ” especially bears ” to a memorial.
Francis Hernandez, the man being held for suspicion of vehicular homicide in the deaths, is now being detained by federal immigration officials.
U.S. Immigration and Customs Enforcement officials sent a faxed detainer on Hernandez, 23, at 12:04 a.m. Saturday, indicating his U.S. citizenship is under question, according to Arapahoe County jail officials and federal authorities.
Hernandez has been arrested 16 times in five years in Colorado but apparently has never been deported, according to Colorado Bureau of Investigation records.
Hernandez had been arrested in Denver as recently as July 18 on a traffic stop and charged with numerous crimes, including resisting police, CBI records say. Had he been held on an ICE detainer at that time, he would have been jailed until his case was completed and his sentence served and then deported, a time-consuming process.
Hernandez is now being held on the ICE detainer and for investigation of three counts of vehicular homicide, reckless driving and hit and run in Thursday night’s accident, Aurora police spokesman Lt. John Sopranuk said:
ating back to 2003, Hernandez has been arrested for mostly misdemeanor offenses 16 times by police officers in Denver, Longmont, Aurora, Westminster, Lakewood and Broomfield and sheriff’s deputies in Boulder, Gilpin and Arapahoe counties, according to Colorado Bureau of Investigation records. His charges have included forgery, assault, theft, fraud and driving under restraint.
Sopranuk said Friday that Hernandez was born in California and is a U.S. citizen.
But he added that detectives could find no indication that he had ever held a driver’s license in California or Colorado.
Also according to CBI records, Hernandez, who has 11 aliases and two listed birth dates, has four listed birth places, including Mexico.

A time consuming process? Really? This is sickening! Does he have a license? Why didn’t he do time for the multiple charges that could have been brought due to lack of a drivers license? These people died because of an illegal alien was let loose, not once but 16 times!

Stories like this are absolutely heartbreaking. Sometimes I think the only immigration reform needed in this country is to simply enforce the current laws.
I heard the woman in San Francisco who lost her husband and sons is suing the city. Megan Kelly on Fox is keeping tabs on this one. I hope she wins.

Considering at least 30% of the murders in the metro Phoenix area are committed by illegal aliens, and that doesn’t count the hit and run deaths why do so many of our politicians keep looking the other way? Yes a lot of them are just hard working people who just want to work. I can appreciate that. Let them work in THEIR countries or come here legally. That way we’ll at least be able to keep the riff raff out. The violent drug wars that have killed thousands south of the border are coming north folks. If we don’t do something to stem the flow of illegals and drugs across the border, we’re going to be in the middle of a bloody war between the Mexican drug cartels and our police. With the ACLU protecting the drug cartels from wiretapping and other surveillance techniques, the police will be sitting ducks.

This a sadly very, very familiar story. In San Francisco a woman recently lost her husband and one of her sons, murdered in cold blood on the streets by an illegal juvenile, repeat offender, who was coddled and enabled by the sanctuary criminals in the City Gov’t. Time to start enforcing the laws, and putting these sanctuary criminals in prison where they belong. Or better yet, run them right out of the country along with their illegal pals.

Bush bears his part of the blame. As do both parties. But who has led the fight the last several years to get to the bottom of this and clean up? That’s right, it has been the HOUSE REPUBLICANS. The Senate elitists have blocked it. The Demcorites want illegals to overrun America (and vote for democrites).

The blame goes on both sides for contributing to the problem. Throw in my ex-governor’s wildly popular of issuing driver’s licenses. To my knowledge, Clinton didn’t do a whole lot here either.

Robert, not sure what clean up effort program you are refering to, but the only thing I’ve been hearing is about guest worker programs and that isn’t a reform, just a band-aid. This usually comes from states that need a lot of imported workers to do the work that Pam claims we don’t want to do

1. Turn OFF the magnet (start enforcing vigorously, end all freebies and bennies).
2. CLOSE the border. Fence, more INS, whatever. Close it tight to illegal traffic.
3. End the anchor baby boondoggle.
4. As illegals come into contact with LE, deport as needed.
5. END all sanctuary. Arrest all public officials who refuse to obey the law, regardless of their position.

If I may add, their IT systems are in horrible shape. INS should be held to the same standards as the rest of Federal IT Systems.
Also for your point #5, I believe you meant arrest all who refuse to “enforce” the law…

I agree that this issue is to be blamed on both sides. I think it is up to us to clean up the mess. I have no problem with immigrants coming hear, but I demand that they use the front door, have the proper paperwork, assimilate into our culture, as the millions before them did, and live by our laws. If you are here legally, I haven’t a problem, but if here illegally, well that is a problem!
