OBAMA CAUGHT SAYING ACORN AND FRIENDS WILL SHAPE HIS PRESIDENTIAL AGENDA

Sen. Cornyn Seeks Nationwide Federal Probe of ACORN

Dear General Mukasey:

I am increasingly concerned by reports of widespread election fraud by the Association of Community Organizations for Reform Now (”ACORN”), which seem to emerge on a daily basis.

Specifically, I call your attention to state and local investigations into potentially hundreds of thousands of fraudulent voter registration applications filed by ACORN in North Carolina, Ohio, Nevada, Michigan, Florida, New Mexico, Missouri, Pennsylvania, Washington, Connecticut, Wisconsin, and my home state of Texas. In Harris County, Texas, which includes the City of Houston, election officials either rejected or discovered serious deficiencies with nearly 40 percent of the 27,000 registration cards filed by ACORN from January through July of this year.

Most recently, election officials in Lake County, Indiana, found more than 2,100 fraudulent voter registration applications that were filed at the deadline by ACORN. According to a CNN report, at least one of ACORN’s applications in Lake County attempted to register a dead man. In addition, The St. Petersburg Times (FL) reported today that Mickey Mouse tried to register to vote in Florida this summer. Although Orange County elections officials rejected his application, it is notable that Mickey Mouse’s application had an ACORN stamp on it. In addition, The [Raleigh, NC] News & Observer also reported today that ACORN conducted a voter drive that registered nearly 28,000 people in North Carolina. But according to local election officials some of the forms it filed had information that may have been copied from phone books.

Election fraud imposes a real cost on our system, beyond the obvious consequence of subverting a free and fair election. Fraudulent voter registration on this scale seriously strains state and local elections resources and distracts elections officials from preparing to conduct an orderly election. Of course, ACORN’s nationwide voter registration fraud provides an opportunity for individuals to vote who should not, or for some to vote more than once.

Given these allegations, as well as the well-documented fraud convictions in recent years of ACORN employees, I urge you to launch a nationwide criminal probe into ACORN’s voter registration activities. As you know, federal law prohibits an individual from (1) providing fraudulent voter registration information; (2) conspiring to encourage false registration or illegal voting; and (3) paying or offering to pay another individual for registering or voting. It is also a crime to knowingly procure or submit false, fictitious, or fraudulent voter registration applications. Finally, I must add that, because the violations of federal voting laws by ACORN employees appear to be so widespread, ACORN and its affiliates should be investigated as a criminal enterprise.

ACORN Watch: RICO suit filed in Ohio

The Buckeye Institute, a Columbus-based think tank, today filed a state RICO action against the Association of Community Organizations for Reform Now (ACORN) on behalf of two Warren County voters. The action filed in Warren County Court of Common Pleas alleges ACORN has engaged in a pattern of corrupt activity that amounts to organized crime. It seeks ACORN’s dissolution as a legal entity, the revocation of any licenses in Ohio, and an injunction against fraudulent voter registration and other illegal activities.

Plaintiffs Jennifer Miller of Mason, Ohio and Kimberly Grant of Loveland, allege that ACORN’s actions deprive them of the right to participate in an honest and effective elections process. They allege fraudulent voter registrations submitted by ACORN dilute the votes of legally registered voters.

“The right to cast a vote that is not diluted by fraudulent votes is a fundamental individual right,” Buckeye Institute President David Hansen said.

“ACORN appears to be recklessly disregarding Ohio laws and adding thousands of fraudulent voters to the state’s roles in the process,” Maurice Thompson, Director of the Buckeye Institute’s 1851 Center for Constitutional Law said. “Such voter fraud erodes the value of legally cast votes,” he added.

In the complaint, Thompson cites an accumulation of evidence showing numerous instances of admitted fraud by ACORN employees, as well as individuals solicited by ACORN.

“In light of its hiring, training and compensation practices, ACORN should have known its conduct would cause fraud,” Thompson said. “It also should know that its conduct will cause fraud in the future.”

In addition, the complaint cites conduct by ACORN in Colorado, Indiana, Louisiana, Michigan, Missouri, Nevada, New Mexico, North Carolina, Pennsylvania, Texas, Virginia, Washington and Wisconsin.

Now Minnesota joins the ACORN parade

The Hennepin County Attorney’s office said today it is investigating whether a voter registration processing lapse at the Minnesota ACORN office falls within guidelines for criminal prosecution.

A malfunctioning scanner at ACORN’s St. Paul offices in August created a backlog that caused a batch of cards to be submitted late to the Hennepin County Elections Board.

All of the registrations were processed in time to allow voters to participate in both the primary and general elections. None was discarded for fraud or ineligibility.

ACORN Watch: 1 voter, 72 registrations, ciggies and cash

A man at the center of a voter-registration scandal told The Post yesterday he was given cash and cigarettes by aggressive ACORN activists in exchange for registering an astonishing 72 times, in apparent violation of Ohio laws.

“Sometimes, they come up and bribe me with a cigarette, or they’ll give me a dollar to sign up,” said Freddie Johnson, 19, who filled out 72 separate voter-registration cards over an 18-month period at the behest of the left-leaning Association of Community Organizations for Reform Now.

“The ACORN people are everywhere, looking to sign people up. I tell them I am already registered. The girl said, ‘You are?’ I say, ‘Yup,’ and then they say, ‘Can you just sign up again?’ ” he said.

Obama: I don’t need ACORN’s help

Obama replied: “[F]irst of all, my relationship to ACORN is pretty straightforward. It’s probably 13 years ago when I was still practicing law, I represented ACORN and my partner in that representation was the US Justice Department in having Illinois implement what was called the ‘Motor Voter’ law, to make sure that people could go to DMV’s and drivers’ license facilities to get registered.. It wasn’t being implemented. That was my relationship and is my relationship to ACORN.

“There is an ACORN organization in Chicago,” Obama continued. “They have been active. As an elected official, I’ve had interactions with them. But they are not advising our campaign. We’ve got the best voter registration and turnout and volunteer operation in politics right now and we don’t need ACORN’s help.

“My understanding in terms of the voter fraud, because having run a voter registration drive, I know how problems arise, this is typically a situation where ACORN probably paid people to get registrations and these folks, not wanting to actually register people because that’s actually hard work, just went into a phone book or made up names and submitted false registrations to get paid,” Obama said. “So there’s been fraud perpetrated probably on ACORN if they paid these individuals and they actually didn’t do registrations.”

“But this isn’t a situation where there’s actually people who are going to try to vote ’cause these are phony names,” Obama said. “And, it’s doubtful (Dallas Cowboys quarterback) Tony Romo (whose name has been fraudulently submitted) is gonna show up in Ohio to vote. So this is another one of these distractions that gets stirred up in the course of a campaign.

“But what I want to make sure of, is that this is not used as an excuse for the kind of voter suppression strategies and tactics that we’ve seen in the past. Let’s just make sure everybody is voting, everybody’s registered. Let’s make sure that everybody’s doing it in a lawful way.”

The extent of his relationship with ACORN was as a lawyer? No training sessions for Project Vote or $800,000 campaign outlays to ACORN affiliates for GOTV efforts?

ACORN REGISTERS ‘MICKEY MOUSE’

ACLU Pressuring Registrars in Virginia to Illegally Allow Out-of-State College Students to Vote in Virginia

Tracy Howard, Radford’s registrar, is paying special attention to voter registration applications that cite a Radford University dorm room as a potential voter’s address, but a student organization and the ACLU of Virginia say that’s illegal.

Howard says he’s following Virginia law the same way he has for 16 years.

“If they give me only a dorm address,” he said, “they will be sent something called a pending denial. It says that you need to have a street address, permanent address, in order to register to vote.”

Kent Willis, the executive director of the American Civil Liberties Union of Virginia, said, “This can only be construed as an attempt to dissuade students from registering to vote in Radford or a ploy to trick them into providing contradictory information that could stall the registration process past the deadline.”

Virginia registrars rarely have problems with students registering to vote, Willis said.

“When they care is when students are geared up to register in large numbers,” he said. “Suddenly, that upsets the whole local power structure.”

Across the country, new voters, particularly young voters, are registering in record numbers, most of them to cast ballots in the presidential race.

Howard says student registration drives are an issue. Groups conducting these drives “have at best simply misinformed on-campus individuals and at worst lied to them” about registration rules, he wrote in his response to the ACLU. They are also holding applications longer than they’re supposed to and flooding Howard’s office with them.

In a letter to Howard on Monday, Rebecca Glenberg, the ACLU’s legal director, cited a string of court decisions that say students can’t be treated differently from other people attempting to register to vote.

“Every individual citizen has the right to vote,” Howard responded. “No individual has the right to register to vote in a community based upon convenience, false information or lies.”

The RU Fair Voter Registration Alliance formed Sept. 15 after student Nikki Rampino registered using her dorm address and received a pending denial notice. After Rampino went to Howard’s office and complained, her application was approved. She got her voter identification card Monday.

Beyond Obamacorn: Democrat Party voter fraud in Louisiana

“They walked in here just mounding up cards,” said Registrar of Voters for Caddo Parish, Ernie Roberson while looking over a box full of thousands of voter registration cards. “They” are a group called Voting is Power, that went door to door in Caddo Parish to register people to vote, “They turned in about 8600 applications, out of that number 1400 new ones, sorted out the new and then we had around 1400 address changes, the rest of them were non existent,” says Roberson.
Before the organization ACORN starting appearing in headlines for reported registration fraud, VIP caught the attention of Louisiana authorities over the summer. “They swamped all of us with a lot of applications but we haven’t had the problem since we aggressively started dealing with that group and I think they just picked up and left Louisiana,” says Roberson.
The Louisiana Secretary of State’s Office is investigating the group, Voting is Power. The Secretary of State won’t comment on the investigation, only to say all the findings will be turned over to the parish district attorneys in the parishes where the cards were turned in. The fear here in Caddo is: The damage has already been done “What I’m afraid of is a lot of people think they are registered, and that’s going to cause problems on election day,” says Roberson. That’s because many of the applications turned in, even with real names, were incomplete, a big headache resulting in thousands of man hours. “It costs money, democracy is very expensive whenever you have to sort through hundreds and even thousands of forms that are either duplicates or completely bogus that costs us time. Ultimately costing the taxpayer money.

Democratic officials said the Louisiana drive, which was called Voting is Power, had produced 74,000 applications by the time it concluded last week. Registrars in the four main parishes where the drive operated report numbers closer to 50,000, but there is no breakdown of how many were submitted to other parishes.

Registrars have reported that as many as a third of the applications cannot be entered into the system, and many of the rest require more information. The state Republican Party called the operation “the Dems’ phony registration drive.”
