What is the upshot of this ruling? It means that the Secretary need not provide the “no match” data to the county boards, and therefore the ORP won’t be able to make its public information requests to get the data to raise voter challenges at the polls:
Lyle Denniston pointed out to me that the Court not only granted the stay, but in its last line it vacated the TRO. So it appears Secretary Brunner won’t have any further obligations to meet the demands of the ORP in this case.

Judging from a quick skim of the syllabus in this case from 2002, which the Court cites as precedent, it boils down to the fact that the voting statute confers exclusive power upon Brunner and the head of the DMV to deal with mismatched forms, which means the Ohio GOP can’t force them to do anything by suing.
IMO, I don’t like the situation, but I can’t argue with the ruling because they are right.
We express no opinion on the question whether HAVA is being properly implemented. Respondents, however, are not sufficiently likely to prevail on the ques-tion whether Congress has authorized the District Court to enforce Section 303 in an action brought by a private litigant to justify the issuance of a TRO….We therefore grant the application for a stay and vacate the TRO.

I understand this to mean the messiah NObama has won Ohio? How can this happen here in america? I guess we should all hold on cuz if this guy wins we will indeed become the United Socialist States. I shudder.

No he did not win Ohio. Ohio shows a tie. I just amended the post. See this portion:

I don’t like the situation, but the SCOTUS ruled correctly. Brunner can still be challenged, but the GOP needs to step back..

I see it that the SCOTUS is basically ruling that Brunner doesn’t have to follow federal election laws. If this is the case, nothing else matters until the law is followed. I understand she is supposed to verify by using DMV and SSN using computer links her office should have in place. Her refusal just adds fuel to the fires.
This gives way too much power to the dems.

Secretary of State Brunner’s JOB is to do everything possible to ensure fair elections. Instead her blatantly partisan actions are guaranteeing massive fraud will be perpetrated in Ohio.
She have established the “rulesâ€:I would expect others to play by those “rules”in 2010.
Perhaps when 200% of the total population “votes”in an election she will finally consider the possibility that maybe there’s some fraud going on! I will urge Ohioans to work towards that goal of 200% turnout!
My entire family on my mother’s side is from Ohio. I am now ASHAMED of that fact!

It is shaping up that the Massive organized Democrite voter fraud machine has a new strategy: Focus their efforts on key states like Ohio.
The ACORN voter fraud scandal is just the tip of a huge iceberg. I’ve estimated in the past as much as 10% of Democrite votes in the big cities are fraudulent. It may hit 15% this time in key states.
