Shades Of Linda Tripp:Maryland may prosecute O’Keefe for shooting ACORN video

STATEMENT OF STATE’S ATTORNEYS OFFICE FOR BALTIMORE CITY RELATIVE TO THE ALLEGED BALTIMORE ACORN INCIDENT

Baltimore, MD – September 11, 2009 – We have received inquiries from citizens and the media asking whether the Baltimore City State’s Attorneys Office would initiate a criminal investigation for acts allegedly committed at ACORN offices located in Baltimore. The only information received in reference to this alleged criminal behavior was a YouTube video. Upon review by this office, the video appears to be incomplete. In addition, the audio portion could possibly have been obtained in violation of Maryland Law, Annotated Code of Maryland Courts and Judicial Proceedings Article §10-402, which requires two party consent.

If it is determined that the audio portion now being heard on YouTube was illegally obtained, it is also illegal under Maryland Law to willfully use or willfully disclose the content of said audio. The penalty for the unlawful interception, disclosure or use of it is a felony punishable up to 5 years.

Most of the “inquiries” they received from citizens — although perhaps not from reporters — surely were demands that ACORN be prosecuted. So they looked at the tape … and decided to go after O’Keefe instead. The news story at the link reminds us that they went after Linda Tripp for wiretapping too, coincidentally another person who made life uncomfortable for a Democratic president. Here’s the statute. You’ll find exception after exception provided for law enforcement to shield them from liability when they tape criminals surreptitiously to serve the public interest. Kind of like how O’Keefe did here.

    Well, that is the way cowards do things. I suppose the d.a. or whoever brought this up has nothing against conservatives. Here’s something to prosecute MD, you are cowards and seditious jerk-wads. Get your thought police in full take-down mode, pray to the altar of your leader and then come and get me. I am sick of ACORN/SEIU/SS/SPLC/ACLU and anyone else that weeps when their precious leader is critcized. BOO HOO. Go live in a mud hut with Obamie in his hometown in Africa.

    There was two party consent when taping, the two people conducting the sting. No law broken. NEXT !!!!!  Go after ACORN and prosecute under the RICO Act.

    The solution is to keep an eye on the DA. O’Keefe operated like a investigative journalist, which means he operated as a free press, the same as say 60 minutes. The courts have given journalists liberties over defamation laws when they can show a greater good in the same legal structure as say: if one sees a burning building and runs inside to save a person’s life, that was a greater good and a legal defense for trespassing.
